These general terms and conditions – that are subject to alteration – concern all services that are made available (directly or indirectly) online, via a mobile phone, by e-mail or by telephone. By going to our (mobile) website, viewing the pages, using and/or making a Reservation via any one of the Platforms (hereafter: the ‘Platform’), you concede to and agree to have read and understood the general terms and conditions below (including the privacy statement) and that you are in accordance with these general terms and conditions.
These pages, the content and the infrastructure of these pages and our offered online Reservation service (including the facilitation of the payment service) on these pages and via the website, are the property of and are managed and offered to you by EventAgent, and are only offered for personal and non-commercial (‘B2C’) use under the general terms and conditions below. Our relationship with Travel Suppliers is subject to separate general terms and conditions that determine the (‘B2B’) commercial relationship that we have with each of these Travel Suppliers. Each Travel Supplier is to act in a professional manner vis-a?-vis EventAgent, when making the product and/or the service available (both for business-to-business (‘B2B’) and business-to-consumer (‘B2C’) relationships). It is important to bear in mind that Travel Suppliers potentially – alongside the terms and conditions and the small print noted on the website – have, and therefore apply and require agreement of their own general terms and conditions (concerning delivery, shipping, transport, usage). Travel Suppliers also potentially have additional rules for use, access to and for the enjoyment of the trip (that may contain disclaimer and restrictions of liability).
EDMbooking.com is a trade name of EventAgent, (Dutch: ‘Eventagent B.V.’), a private company with limited liability under Dutch law and has its office at de Rading 10/12 1231 KA in Loosdrecht, The Netherlands.
‘Platform’ is the (mobile) website where the Travel Service is available and is the property of, controlled by, managed, serviced and/or hosted by EDMbooking.com.
‘Travel’ is defined as the diverse travel products and services that can be - combined or complete - provided, acquired, bought, obtained, paid for, hired, offered and reserved by you from the travel agency.
‘Travel Supplier’ is the professional offeror of accommodation (i.e., hotel, motel, apartment, bed & breakfast), attractions (i.e., theme parks, museums, sightseeing tours), transport agencies (i.e., car hire, train travel, other forms of public transport, airport, touring cars, transfers), tour operators, travel insurance and all other travel or connected products or services that are made available to reserve on the Platform from time to time.
‘Travel Service’ is the online purchase, order (facilitated) payment or Reservation service as offered or made possible by EDMbooking.com in relation to the diverse products and services that are made available by Travel Suppliers on the Platform.
‘Reservation’ is the order, purchase, payment, booking or Reservation of a trip.
1. Our Service
Via our Platform, we offer (EventAgent B.V. and its affiliated partners) an online Platform where Travel Suppliers can offer products and services for Reservation by advertising, trading, offering for sale, promoting and/or can offer (where applicable) visitors to the Platform to discover, search, compare and place an order, to reserve or make a purchase or make a payment (namely, the ‘Travel Service’). By using the Travel Service (for example, by making a Reservation via the Travel Service), a (contractually binding) relationship has been formed with the particular Travel Supplier or suppliers with whom the Reservation of a product or service (as applicable) has been obtained. From the moment that your Reservation is made, we shall act exclusively as the intermediary between you and the/each Travel Supplier; we shall send the details of your Reservation to the Travel Supplier(s) concerned and shall send you an e-mail of confirmation for and on behalf of the Travel Supplier.
EDMbooking.com does not (re)sell, hire, offer any (travel) products or services.
The information that we release in providing our Travel Service is based on the information made available to us by the Travel Suppliers. The Travel Suppliers who advertise and promote a trip on the Platform are given access to an extranet and are entirely responsible for updating all tariffs/supplementary charges/prices, availability, policy, conditions and all other relevant information displayed on our Platform. We pay a lot of attention and care when offering our Travel Service but we are unable to verify the information or to be held accountable for any kind of error (including any eye-catching and typographical mistakes), any kind of interruption to the service (whether arising out of (temporary and/or partial) defects, repair work, upgrading, maintenance of our Platform or anything else that may occur), inaccurate, misleading or non-trusted information or for any potential lack of information. Each Travel Supplier is solely responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including tariffs/supplementary charges/prices, availability, policy & conditions) displayed by the Travel Supplier on our Platform. Our Platform is not a recommendation or confirmation of the quality, the level of service, the classification of the star rating of a Travel Supplier (or of the facilities, location, vehicles, main or by-products) that become available and should never be regarded as such.
Our Travel Service is made exclusively available for personal and non-commercial use. Therefore, it is not permitted to re-sell, screen (i.e., spider, scrape), to reproduce, deep link, use, copy, display or download any (substantive) information, software, Reservations, tickets, products or services or anything else offered on our Platform for any kind of commercial or competitive aim or activity.
Prices offered by Travel Suppliers are most competitive. All prices for your booking appear including VAT/sales tax (subject to amendment of such taxes) and supplementary charges unless otherwise stated on our Platform or in the confirmation e-mail. Ticket prices apply per person and are subject to the validity or expiry date as shown on the ticket.
The tariffs as shown by EDMbooking.com are made available by the Travel Supplier and are unable to be refunded - both non-cancellation and non-refund are therefore applicable. Please read the relevant product, service and booking conditions carefully before making your Reservation. Check the (Reservation) details of your chosen product or service carefully before placing your booking.
3. Privacy and cookies

4. Credit/debit card, bank transfer or payment by PayPal
EDMbooking.com never acts nor operates as the merchant of record. Your payment is safely processed from your credit/debit card, PayPal, or bank account to the bank account of the Travel Supplier through a third-party payment processor.
Any payment facilitated by us for and on behalf of, and transferred to the Travel Supplier will in each case constitute a payment of (part of) the booking price by you of the relevant product or service in final settlement (discharge by payment / bevrijdende betaling) of such (partial) due and payable price and you cannot reclaim such paid monies.
It is not permitted to hold EDMbooking.com liable or responsible for the (authorised, (alleged), un-authorised or incorrect) transactions or to demand the retrieval or restitution of valid or authorised payments from your credit card by the Travel Supplier (including pre-paid tariffs, no-shows and taxable cancellations).
In the event of credit card fraud or the unauthorised use of a credit card by third parties, the majority of credit card companies tend to absolve the risk and remunerate all costs resulting from such misuse: this can prove to be subject to an own risk payment (usually 50 euros, or the equivalent in local currency). In the event that the credit card company or the bank charge you for the own risk payment due to an unauthorised transaction that has resulted from a Reservation made via our Platform, we shall cover these own risk costs of up to a total amount of 50 euros (or the equivalent in local currency). In order to be eligible for compensation, the fraud must be registered by your credit card company (in accordance with their reporting guidelines and procedures). Please e-mail us immediately at email@example.com and write ‘Credit Card Fraud’ as the subject in the title of the e-mail, providing evidence of the own risk payment (e.g., the terms and conditions of the particular credit card company). The above-mentioned compensation only applies to credit card Reservations that have been made via the secure server of EDMbooking.com and where the unauthorised use of your credit card has resulted in a lack of fulfilment of obligations or negligence on the part of EDMbooking.com and additionally, you have not been at any individual fault during the use of our secure server.
5. Pre-Payment and cancellation
By making a Reservation with a Travel Supplier, you agree to all applicable cancellation and no-show conditions and all additional (delivery) conditions of the Travel Supplier that may be relevant to your Reservation or your stay (including the small print of the Travel Supplier noted on our Platform and the applicable additional conditions of the particular Travel Supplier), including services rendered and/or products offered by that particular Travel Supplier. The conditions for delivery, sale, use and transport can be obtained by each particular Travel Supplier. The cancellation and no-show general terms and conditions of each Travel Supplier are available on their information pages on our Platform, during the Reservation process and in the confirmation e-mail or on the ticket (where applicable). Please bear in mind that certain tariffs, supplementary charges or special offers cannot be changed, refunded or cancelled. In the event of a no-show or cancellation, the Travel Supplier can charge the applicable tourist tax. Before making a Reservation, it is advisable to carefully read the (Reservation) details of the product or the service of your choice for such conditions. Please note: a Reservation that requires a payment or a deposit (in whole or in part), can be cancelled (without prior notification or warning) in the event that the relevant (outstanding) amount/amounts cannot be collected in full on the required expiry date or date of payment in accordance with the conditions of the Travel Supplier and the particular Reservation. The conditions regarding cancellation and pre-payment can differ per segment, product or service for each trip. We request that you read the small print carefully (noted with the particular booking or at the bottom of the page of the Travel Supplier on our Platform) and also the essential information in your Reservation confirmation, This confirmation may contain additional terms and conditions that may be applied by the Travel Supplier (i.e., with regard to the age of the guests, deposit, non-refundable tariffs/supplementary charges for group bookings, extra beds/breakfast not included, admission of pets, accepted credit cards). Costs resulting from late payment, incorrect bank, bank card or credit card details, an invalid credit/debit card or insufficient limit on your card are fully for your own cost and at your own risk. You have no right to a refund of a (non-refundable) pre-payment amount unless the Travel Supplier is in accordance with this or if this is mentioned in the (pre) payment – and cancellation policy.
Before viewing or amending your booking, please refer to the confirmation e-mail where the relevant instructions are duly noted.
In the event of late or delayed arrival on your day of check-in or arrive the next day, please ensure that this is communicated (timely/directly) to the Travel Supplier, in order that they are aware of the time that you can be expected and to avoid your Reservation being cancelled or receiving costs for no-show. Our Customer Service can assist you in notifying the relevant Travel Supplier. EDMbooking.com is unable to accept any liability or responsibility for any consequences that may arise from late arrival or cancellation.
6. (Further) correspondence and communication
By completing a booking, you agree that (i) you may receive an e-mail shortly before your arrival date including information about your destination as well as certain information & offers relevant for your trip and your destination, (ii) shortly after arrival, you may receive an e-mail asking you to evaluate (your experience with) the Travel Supplier and the Travel Service, and (iii) may receive an e-mail shortly after your stay in the accommodation asking you to fill in a guest evaluation form. EDMbooking.com does not accept any liability or responsibility for any potential communication with the Travel Supplier on or via their Platform. You are unable to derive any rights from any requests to the Travel Supplier or communication with the Travel Supplier, or from (any form of) confirmation of receipt of every request or message. EDMbooking.com is unable to guarantee that every request or message is (duly and timely) received/read, observed, executed or accepted by any particular Travel Supplier.
In order to complete your travel Reservation properly and securely, you must ensure that you have used your correct e-mail address. EDMbooking.com cannot be held responsible or liable for incorrectly submitted e-mail addresses or incorrect telephone or credit card numbers (and are not under any obligation to verify this data).
All demands made towards or complaints against EDMbooking.com or with respect to the Travel Service must be submitted as soon as possible but in any event within 30 days after the scheduled date of the use of the product or service (e.g., check-out date). Any demand or complaint that is submitted after the 30-day period may be refused and the claimant may lose the right to any compensation (for damage or costs).
For travellers (within the European Economic Area): we recommend that complaints are first submitted to us by contacting our Customer Service. If your complaint remains unresolved, it is possible to upload your complaint via the ODR-Platform of the European Commission. All events and festivals offered on EDMbooking.com are organised at the expense and risk of the event/festival organisations. The general terms and conditions of the event or festival are applicable to the tickets of admission. EventAgent does not accept liability for anything in relation to the stay of the visitor in or on an event or festival or for a cancellation and/or modification of an event or festival. Any potential damage that occurs during or after an event or festival or as a result of the cancellation and/or changes to an event or festival is only recoverable from the event or festival organisation. EDMbooking.com is emphatically not responsible for this.
Dependent on the restrictions as set forth in these general terms and conditions and as far as is legally permitted, we are only expressly liable for any direct damage that has actually been incurred by you or that has been paid for or suffered, due to an unarguable shortfall in our obligations relating to our services, to a lump sum amount of the total cost of your travel Reservation as set out in the confirmation e-mail (for one incident or for a series of related incidents).
We, or any of our directors, employees, affiliates, affiliated distribution partners, license holders, or any other intermediary agents involved in creating, sponsoring or promoting the website or otherwise making the website available (including the content), shall not be liable as far as is permitted under the law for (i) any damage punitive in nature, special, indirect or resulting loss or damage, loss of production, loss of profit, loss of revenue, loss of contract, loss or damage of goodwill or reputation, loss of any type of claim whatsoever, (ii) any form of inaccuracy with regard to the (descriptive) information (including pricing, availability and standard) made available by the Travel Supplier through our Platform, (iii) the services or the products that the Travel Supplier or other business partner offer, (iv) any form of (direct or indirect, arising or incurred due to damage suffered) damage, losses or expenses suffered by or paid by you, whether arising from (legal) activities, that are the consequence of or are connected to the use, inability to use or from any delay on our Platform, (v) any (personal) injury, death, material damage or any other (direct, indirect, special, arising or has been incurred due to damage suffered) damage, loss or expenses that you have incurred or have paid as a result of (legal) activities, error, breach, (gross) negligence, wilful misconduct, omissions, default, misrepresentation, tort or strict liability by or (in whole or in part) due to the Travel Supplier or any other business partner (employees, directors, managers, agents, representatives or affiliated companies), whose services are offered or promoted, directly or indirectly, including any (partial) cancellation, transfer, strike, force majeure or any other event beyond our control.
EDMbooking.com cannot be held responsible (and rejects any liability) for the use, validity, quality, applicability, the suitability and appropriate disclosure of the trip and will offer no statement, guarantee or condition of any kind in this respect, either expressly or implicitly,
statutory or otherwise, including implied guarantees of saleability, title, non-infringement, or suitability for a particular purpose. You acknowledge and agree that the relevant Travel Service supplier is solely responsible and takes all responsibility and liability for the trip (including all guarantees and representations made by the Travel Supplier). EDMbooking.com is not the (re)seller of the trip. Complaints or claims in relation to the trip (including anything with respect to the offered (special/promotional) price, conditions or specific requests by customers) must be handled by the Travel Supplier. EDMbooking.com is not responsible for and rejects all liability with respect to such complaints, claims and (product) liability.
You agree that the Travel Supplier is at all times responsible for the remittance of, the collection of, the withholding of and for the payment of applicable taxes on the total amount of the (travel) price to the relevant tax authorities, regardless of whether the tour operator charged for these costs for your trip or that we have been responsible for the facilitation of the payment of the (travel) price. EDMbooking.com is not liable or responsible for the remittance of, the collection of, the withholding of or the payment of applicable taxes on the (travel) price to the relevant tax authorities. EDMbooking.com will never act or deal as a vendor for any product or service on the Platform.
8. Intellectual property rights
The software required for our services, made available by us or used by our Platform and the intellectual property (including the copyright) of the content and the information and materials on our Platform is, unless otherwise stated, the property of EDMbooking.com, its Travel Suppliers or providers.
EDMbooking.com exclusively retains ownership of all rights, title and interest in and to (all intellectual property rights of) (the look and feel (including infrastructure) of) the Platform on which the service is made available (including the guest reviews and translated content) and you are not entitled to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or otherwise use the content (including any translations thereof and the guest reviews) or our brand without our express written permission. To the extent that you would (wholly or partly) use or combine our (translated) content (including guest reviews) or would otherwise own any intellectual property rights in the Platform or any (translated) content or guest reviews, you hereby assign, transfer and set over all such intellectual property rights to EDMbooking.com. Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our intellectual property rights (including copyright and database right).
9. Applicable law, Jurisdiction & Dispute Resolution
These terms and conditions and the provision of our services shall be governed by and interpreted in accordance with Dutch law. Notwithstanding the previously stated legal jurisdiction, a natural person who uses our services for a purpose which can be regarded as being outside his business or profession (hereafter also referred to as the ‘consumer’) may rely on the mandatory provisions of the law of the country in which he has habitual residence (namely the provisions which, in accordance with the law of that country, should be applied, regardless of this choice of law clause; hereafter referred to as ‘Mandatory Provisions’). Any dispute arising out of these general terms and conditions and our services shall exclusively be submitted to the competent courts in Amsterdam, The Netherlands. Notwithstanding the previous jurisdiction clause, a consumer can also bring an action concerning the enforcement of the relevant applicable Mandatory Provisions to the courts of the country in which he is resident and a claim can only be brought against a consumer in the courts of the country in which he lives. If your complaint remains unresolved, it is possible to upload your complaint via the ODR-Platform of the European Commission. The original English version of these terms and conditions may have been translated into other languages. This is a service; the translated version is not the official version. In the event of a difference or discrepancy between the English version and its translation, the English version remains, as far as is legally permitted, the definitive version. You are unable to claim any rights by way of the translated version.
In the event that any provision of these terms and conditions is or becomes invalid or is dissolved, you shall still remain bound to all other provisions of these terms and conditions. In such a case, the invalid or dissolved provision shall be replaced by provisions which are binding and that are as far as possible similar to the previously applicable provision which is invalid or has been dissolved.
